In addition to the popular “initial training in the area of rules of conduct according to FIDLEG”, in which the specialists at AvelaLaw AG have trained over 300 people, AvelaLaw AG now also offers the mandatory refresher courses (continuing education) for client advisors who, in accordance with Art. 28ff. of the Federal Act on Financial Services of June 15, 2018 (“FIDLEG”), are already registered in an advisor register and must renew this registration every two years.

AvelaLaw AG is accredited with BX Swiss AG, one of the registration offices approved by FINMA, as a provider of both initial training and a refresher course, and is listed on the two lists “Basic training” and “Recurring training” of BX Swiss AG https://www.regservices.ch/kenntnisse/.

Information on Initial Training: Registration Requirement for Client Advisors in the Advisor Register

Client advisors of non-supervised Swiss financial service providers and of certain foreign financial service providers may only carry out their activities in Switzerland if they are entered in an advisor register. This registration requirement particularly affects client advisors who provide financial services that are not already a licensable activity as such, e.g. investment advice or the acquisition or sale of financial instruments for clients (formerly known as “distribution”).

The advisor register is maintained by registration offices approved by the Swiss Financial Market Supervisory Authority FINMA. Approved registration offices are BX Swiss AG, Zurich, PolyReg Services GmbH, Zurich, and Association Romande des Intermédiaires Financiers (ARIF), Geneva. The training courses offered here are accepted by all three registration offices.

The requirements for registration in the advisor register are met by those who can provide the following evidence:

Conclusion of professional indemnity insurance or equivalent financial security;
Connection to an ombudsman's office (unless an exception applies);
Non-existence of exclusion criteria (relevant criminal conviction, professional ban, activity ban);
Existence of the necessary knowledge in accordance with Art. 6 FIDLEG, i.e. (i) the specialist knowledge necessary for the activity and (ii) sufficient knowledge of the rules of conduct required under FIDLEG for the provision of financial services. Specialist knowledge and knowledge of the rules of conduct according to FIDLEG must be proven separately.

Information on the Refresher Course: Obligation to Renew Registration in the Advisor Register

Client advisors who are already registered in an advisor register must, in application of FIDLEV 41/2, renew this registration no later than two years after its expiration, otherwise the registration in the register will be deleted. In this context, further training must be completed to deepen knowledge and address changes in legal regulations.

According to the requirements of the registration offices, the further training should last at least two hours and cover the following content:

Changes to the legal regulations since completing the basic training;
Deepening knowledge of the rules of conduct;
Practice and case law on the topics of basic training;
Other financial market laws (CISA, AMLA, FMIA, etc.) and their effects on the activities of client advisors.
